1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Candidate Collective Inc. ("Candidate Collective," "we," "us," or "our"), governing your access to and use of our website at candidatecollective.com, the community platform, and all related services, features, and content (collectively, the "Platform").

By creating an account, registering as a candidate or employer, endorsing peers, or browsing our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Platform Overview & Services

Candidate Collective operates a referral-driven hospitality talent platform that connects hospitality professionals ("Candidates"), industry peers who vouch for talent ("Referrers"), and hospitality venues and restaurant groups ("Employers").

Our services include talent network discovery, peer endorsements and vouches, verified employer company profiles, appointment scheduling, and career pathway matching. Candidate Collective is a networking and matching technology platform and is not an employment agency or employer of Candidates.

3. User Accounts & Eligibility

To use certain features of the Platform, you must register for an account. By registering, you represent and warrant that:

• You are at least 18 years of age and legally capable of entering into binding contracts.
• All registration information you submit is accurate, current, and complete, and you will maintain and update such information.
• If you register on behalf of a business entity (Employer), you represent that you have the requisite authority to bind that entity to these Terms.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Community Standards & Code of Conduct

Candidate Collective thrives on trust, integrity, and verified peer relationships. You agree not to:

• Provide false, deceptive, or fraudulent endorsements, work history, or qualifications.
• Submit vouches for individuals with whom you have no genuine professional experience.
• Scrape, spider, crawl, or use automated means to harvest member data, contact details, or company listings from the Platform.
• Impersonate any person, venue, or brand, or falsely state or misrepresent an affiliation with any entity.
• Upload or transmit harmful code, viruses, spam, unauthorized solicitations, or infringing material.
• Use the Platform in violation of any applicable federal, state, or local labor, employment, or privacy laws.

5. Referral & Employment Disclaimers

No Guarantee of Employment: Candidate Collective does not guarantee that Candidates will receive interviews, offers, or employment. Vouches and endorsements represent opinions of individual community members and do not constitute representations or warranties by Candidate Collective.

Hiring Decisions: All hiring, compensation, interviewing, and employment decisions are made solely and independently by Employers. Candidate Collective is not a party to any employment contract or agreement between Employers and Candidates.

6. Intellectual Property

The Platform, including all text, design, graphics, code, and interfaces, is the proprietary property of Candidate Collective Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior express written permission.

You retain ownership of the content and profile details you submit, but grant Candidate Collective a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely to operate and deliver the Platform services in accordance with our Privacy Policy.

7. Termination & Account Deletion

You may delete your account at any time through your account settings or by visiting How to Delete Your Account. Upon request, your account and personal data will be processed for removal in accordance with our Privacy Policy.

Candidate Collective reserves the right, in its sole discretion, to suspend or terminate accounts that violate these Terms, engage in fraud, compromise member trust, or disrupt the operation of the Platform.

8. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CANDIDATE COLLECTIVE DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL CANDIDATE COLLECTIVE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR INTERACTIONS WITH OTHER USERS.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New York County, New York.
